Nope.  Consent given under the influence of alcohol or drugs does not count as consent.  Why?  Simply because the person who is blacked out (browned out, clearly drunk) is not in the right state of mind to give proper, informed consent. 

Is it still rape even if the guy doesn’t realize she’s clearly blacked out drunk?  Yes. 

Also, in regards to actually blacking out, it is very obvious when someone is THAT DRUNK.  If you see someone like that, don’t proposition them for sex, and don’t accept propositions from them.  It’s best to wait until you’re both sober enough to make genuine informed decisions.
